1. Acceptance of Terms
By accessing or using CourtWatch Hawaii ("the Service"), operated by Patrick Astoul ("we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
2. Description of Service
CourtWatch Hawaii is a deadline monitoring and reminder tool for licensed attorneys practicing in the State of Hawaii. The Service monitors publicly available court records from eCourt Kokua and provides automated deadline reminders based on the Hawaii Rules of Civil Procedure (HRCP).
3. Eligibility
The Service is intended for use by licensed attorneys, paralegals, and authorized legal professionals. By using the Service, you represent that you are a legal professional or are authorized by a legal professional to use the Service on their behalf.
4. Not Legal Advice
THE SERVICE DOES NOT PROVIDE LEGAL ADVICE. CourtWatch Hawaii is a technology tool that assists with deadline tracking. It does not replace the professional judgment of an attorney. Users are solely responsible for verifying all deadlines, court dates, and filing requirements independently.
5. No Attorney-Client Relationship
Use of the Service does not create an attorney-client relationship between you and CourtWatch Hawaii or its operators. The Service is a software tool, not a legal service provider.
6. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or interfere with the Service
- Share your account credentials with unauthorized persons
- Use the Service to harass, abuse, or harm others
- Resell or redistribute the Service without written authorization
- Attempt to access data belonging to other users
8. Data Sources and Accuracy
The Service relies on publicly available data from the Hawaii State Judiciary's eCourt Kokua system. While we strive for accuracy, we cannot guarantee that court data is complete, current, or error-free. Deadline calculations are based on general HRCP rules and may not account for local court rules, standing orders, or case-specific circumstances.
YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL DEADLINES AND COURT DATES THROUGH OFFICIAL COURT RECORDS.
9. Payment and Subscription
Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are provided at our sole discretion.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTWATCH HAWAII AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO MISSED DEADLINES, MALPRACTICE CLAIMS, COURT SANCTIONS, LOSS OF CLIENTS, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless CourtWatch Hawaii, its operators, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the State of Hawaii.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
